The purpose of this work is to carry out both a review and a critical analysis as part of the review. In the first part of the review, a summary understanding of the article was presented. The second part reviews the article critically with supporting and dissenting evidence from other scholarly articles. The article attempts to present a new dilemma in context with the Samaritan actions. A Samaritan is someone who aids a person in distress. China lacks Good Samaritan laws and does not have the effective legal elements necessary to protect the Good Samaritan from extorted by the victim. This hence leads to a paradigm of problems. The author argues that social trust, compassion and the principle of reciprocity are lost because of extortion used on the good Samaritans.

Yan (2009) argued that it becomes easier for people to not assist a stranger in distress. They walk away from the stranger in distress, because they do not want to become part of an extortion scheme. On a larger magnitude, it creates a society that has no trust or compassion for one another.

Yan (2009)’s argument is supported in other research works, too. Bu (2017) believes that apathy is fast entering Chinese mainstream society. Apathy is defined as the lack of concern. A society that has a high degree of apathy will not care or have concern about others. In the moral realm, this is a perilous development for society. According to Bu (2017) apathy has developed in the Chinese society as people who would generally step in to assist a stranger are stopped in their actions because of fear of liabilities and extortion activities. Imposing a legal duty would not improve the situation, but having some form of Samaritan law to protect the Samaritan who will be beneficial in such situations.

The long awaited Good Samaritan law finally was passed in Shanghai in the year 2016. It was passed to ensure that when a citizen without first aid steps in to assist someone by carrying out calls to emergency services and doing first aid with guidance, they would be protected even if something goes wrong (Linder, 2016). Now this Samaritan law is not broad in its interpretation and will not account for such situations like that of what Yan (2009) presented, but it is indeed a first when it comes to recognizing the legal protection that is needed for the Good Samaritan.

Conclusion

Good Samaritan laws have to be passed with more discussion on the legal loopholes through which Samaritans could land in trouble when they are assisting someone out. If that is the only way to create a compassionate society, then the law should indeed recognize the Samaritan’s importance.
