A copyright refers to the “exclusive right” which is given to an assignee or an originator to publish, film, print, perform, or even record literary, musical, or artistic material, and to authorize or permit other people to do the same. A copyright can also be defined as being a form of protection which is provided by the laws of a specific country or nation to authors of the original “works of authorship”. On the other hand, a patent refers to a license or government authority that confers a title or a right for a specific set period of time frame, and specifically the sole right of excluding other people from using, making, or even selling a specific invention. In addition to that, a patent can be defined as being a government license which gives the holder specific exclusive rights towards a new invention, design, or process for a period of time that is designated. It is prudent to note that at most times, applications for such patents are normally done by a governmental agency (Chatterjee, Kubo, & Pingali, 2013, p. 408). For instance, the “U.S Patent and Trademark Office” usually handles such applications as well as documentations.
Infringement of a patent or patent infringement for that matter refers to an act of using, making, offering to sell, or selling a patented invention, or importing into a country a product which is covered by a patent claim without the sole permission or authority of the patent owner. On the other hand, copyright infringement refers to the using of works which are well protected by copyright laws without the authority or permission, thus infringing on certain or specific rights that have been granted to the holder of the copyright (Sharma & Sharma, 2012,p. 18). This includes rights of reproducing, distributing, performing, or displaying the protected work as well as making derivative works. This research paper discusses an infringement of a patent-protected innovation of Delhi HC by Glenmark which are both drug manufacturing companies. This research paper will seek to explain how both companies have operated, legally, and strategically and also further discusses how the case between the two firms has affected the subsequent strategy of each firm.
